
New Delhi, October 28 (Udaipur Kiran): The Supreme Court has agreed to hear a petition filed by a man who spent 12 years in prison before being acquitted of rape and murder charges. The plea seeks compensation for wrongful arrest, trial, and conviction, claiming grave injustice and violation of fundamental rights.
A bench headed by Justice Vikram Nath took up the matter and directed that it be listed for detailed hearing on November 24. The court has also requested the Attorney General and Solicitor General to assist in the case.
According to the petition, the man was arrested in 2013 and sentenced to death by a Thane district trial court in 2019. The Bombay High Court upheld the conviction. However, in May 2025, the Supreme Court acquitted him of all charges, observing that the investigation was “defective” and lacked credibility.
The petitioner, a resident of a village in Uttar Pradesh, has stated that he was falsely implicated and that his arrest was made illegally on fabricated evidence. He argued that mere acquittal after years of wrongful confinement does not amount to justice and that the State must provide compensation for the mental and economic suffering he endured.
As per the plea, the man spent 12 years in jail, including six years under the shadow of a death sentence, which caused severe trauma and hardship.
