Supreme Court Stays Key Provisions of Waqf (Amendment) Act 2025 | Udaipur Kiran


New Delhi, 15 September (Patrika English News): The Supreme Court on Monday put a stay on certain provisions of the Waqf (Amendment) Act 2025 while hearing a petition challenging its validity.

The court stayed the clause that required a person to have followed Islam for at least five years to be eligible for membership in a Waqf Board. The bench observed that this provision cannot be enforced until proper rules are framed.

The apex court also stayed the provision related to revenue records under Section 3(74) of the Act. It ruled that until the inquiry of the designated officer is completed, and ownership of Waqf property is decided by the Waqf Tribunal or the High Court, no person can be evicted from such property.
